Discuss the view that the UK Constitution has become too flexible (30 marks) The key features of the UK constitution is that it’s uncodified, there’s not a single document stating the rules, its developed from various sources e.g. common law, statutory law, EU Law and relies on tradition as much as nay written documents. The main advantage of this is that it can easily be changed allowing us to evolve E.g. Regional Devolution (Scotland, Wales, and Northern Ireland). The UK has a unitary constitution, where all power and authority resides in Parliament.
A political model that that fits the book’s political beliefs would be majoritarianism. Majoritarians believe that decisions should be made by a numerical majority of its members, in other words, decisions in the US should be made by the whole country, not the few in Congress and the House that decide what laws are passed and who are influenced by monetary bonuses from outside sources. This would be the most efficient way to handle our politics, that way everyone has a say, instead of the rich doing what’s right for the rich and leaving the middle and lower social class struggling. The pluralist model does not relate to the book at all. Pluralists believe that that politics and decision making is located within the government and outside sources have no influence on the government, which is a lie since interest groups an election fundraising exists.
Referenda are a general vote put upon the electorate on a single political issue and are a direct form of democracy; referenda usually allow the voters to choose between yes/no option or two alternatives. The UK uses a form of representative democracy, the principles of which elected officials represent a group of people to make a decision on their behalf (Burkean model of representation). Referendums have been sparsely used in the UK as there is no established tradition of them and some political leaders argued strongly against the use of referendums. Clement Attlee (labour party leader from 1935-55 and prime minister from 1945-51) felt that “referendums are just not British” because he stressed they were too often used by dictatorships. The delegate model of representation poses a threat to the form of representative democracy used on the UK as the public will have more say on issues which undermines the Burkean model.
The system of the United States is a presidential democracy. We can categorise the United States as a democracy as there are competitive elections for the Presidency and the Legislature. Even though the two-party system arguably creates a more stable government than a multi-party system, the two-party system is very unfair. The two-party system contrives an inequitable system where primary parties are afforded significantly larger power, social influence, and consequently crush their third party competitors in every presidential election.
