He is indirectly saying; court’s rulings give back power to the people. So, therefore, they are not superior to the other two branches but rather, as written by Hamilton (1788) “the power of the people is superior to both…” (p.257). Also, Hamilton strongly rooted for judicial review and regards Brutus’ fear against it as a false reasoning based on misconstrue fact. Hamilton (1788) stated that it is the judiciary’s job “to declare all acts contrary to the manifest tenor of the constitution void,” (p. 258) and without judicial review, “all the reservations of particular rights or privileges would amount to nothing” (p. 258). Hamilton (1788) defended the need for the
Powerful Branch (Bramble) In the United States Government there are three branches known as legislative, executive, and judicial that make up the government. Professor Ryan Emenaker likes to refer to these three branches as brambles. He refers to the branches as brambles because they have shared powers and the branches are always conflicting when it comes to who has what power. The United States government branches were suppose to be designed in a way that would not cause a conflict between them about which branch had what power. The judicial, executive, and legislative branches are suppose to be equal when it comes to the amount of power each of them have.
Meanwhile, Anti-Federalist believed power should remain with the states. As you can see the Anti-Federalist was against the constitution. “New Constitution Creates a National Government, Will not Abate Foreign Influence, Dangers of Civil War and Despotism“. The main reason they revoked the constitution is bad is because it divided the powers amount the government in 3 branches (Judicial, Legislation, Executive), so NO ONE had supreme power over. Anti-Federalist didn’t approved they wanted a bill of right instead.
* Federalists- People who supported the Constitution during its adoption. They believed in large national government, weaker state government, and government by the elites. * Anti-Federalists- People who opposed the Constitution during its adoption. They wanted a small national government, strong state government, rule of the common man, and protections of individual liberties. * Define and give an example of separation of powers and checks and balances * Separation of powers- An aspect of the Madisonian Model of government that requires each of the three branched of government to be independent of and to share power with each other so that one cannot control the others.
Locke's influence can be seen in documents such as the Declaration of Independence, the Constitution and the Federalist Papers. Locke’s philosophy of government, freedom, and natural rights challenged the power of England’s monarchy in Europe over the colonies in America. Although the foundations of these documents are highly influenced by John Locke's ideology, there are parts of these documents that stray away from his views. In this paper I will examine certain parts of the Declaration of Independence, The Constitution, and the Federalist Papers and argue that for the most part, if John Locke were alive today he would be pleased with these documents but I will also highlight parts of these documents that would concern him. The first document I will analyze is The Declaration of Independence which I consider to be the most influenced by Locke's ideology of any document the founders drafted.
How one interprets this information and correlates it into their personal beliefs and actions can be overwhelming. This can lead to strong convictions that politics in general are disintegrated and are irrelevant. Apathy towards the government and politics becomes more of a norm for some people, so why bother to vote at all? What is the incentive and why should it matter? I would address these issues with someone who has these dispositions in a number of ways.
The theory of cognitive dissonance can be relative in a various ways when applied to use. For example, a 1998 article in the Washington Post written by Deborah Tannen addresses how society is compelled to quarrel about everything. Tannen expresses how the majority of society holds value to being aggressive and contentious in contrast to cooperation and conciliation. She further explains that society has become an argument culture that assumes that opposition is the best way to address issues (Tannen, 1998). If two conflicting issues collide into each other, only one issue could prevail because it is the most sensible.
Alexander Hamilton once stated, "Why has government been instituted at all? Because the passions of men will not conform to the dictates of reason and justice, without constraint." By saying this, Hamilton meant a government is required because people cannot make decisions based upon their instincts. The voice and thoughts of one are too irresponsible or unreasonable to make decisions. Mankind needs laws and obligations to live by, not only to keep peace but to protect ourselves from our basic nature.
Representations 1, 2 and 3 are all representations on the impact of protest on US Society. Representation 1 is about the impact by the Civil Right Movement. Representation 2 is about the impact of Martin Luther King Jr and the Civil Right Movement in America. Finally, representation 3 is about the impact of the Freedom Riders. In this essay, I will be analysing and commenting on which Representation I think is the best, based on accuracy, balance and completeness.
Authority is a power exercised by a person in virtue of his office or trust; dominion; jurisdiction; authorization. In general, for any society to function it must be run by an authority. However, I think that questioning authority make a society stronger. In first, Dissent makes society stronger by representing the needs of the many. Modern examples include Martin Luther King and even Ralph Nader.
