Mostly the Anti-Federalists thought that the Constitution created too strong of a central government. They felt that the Constitution did not create a Federal government, but a single national government. They were afraid that the power of the states would be lost and that the people would lose their individual rights because a few individuals would take over. As a result, they proposed The Bill of Rights, to make sure the citizens were protected by the law. They believed that no Bill of Rights would be equal to no check on our
Therefore an amendment was needed so they could participate in this right. Citizens assumed they would be protected by their own states’ constitution, so it was not until the Fourteenth Amendment was passed, therefore, Americans were not impacted by the Bill of Rights. The federal government grew in purpose, size and significance as a result. Because of this, debates began with the Bill of Rights which still leaves some questions to this very
Instead the president has to follow the wishes of the Congress and how they want that law to be regulated. Thus proving yet another way Congress can exceed the powers of another branch. Congress also have the power to alter a proposed bill and changing it to better suit their particular views and how they want the law to be constructed. Yes like stated before the president can do this but the judicial system can not. The only thing the judicial system can do is uphold that law the way congress intended but they don’t have the power to change it.
Congress: He supported the idea a new constitution (one that followed the New Jersey Plan) to be signed into law. He was so against the idea of some states not having as much rights as others that he threatened to make alliances with other countries to insure the small states were cared for. As the convention went on Bedford became more flexible and was in the committee that drafted the Great Compromise, which he supported. Voting Rights: Bedford cared more about states right than voting rights of individuals in the convention. Legislative wise, he supported the New Jersey Plan where each state would have the same amount of representatives in congress regardless of their size, thus giving all states an equal vote.
Faction, a problem could not avoid in American society because of the vast different opinions. In favor of republican, James Madison emphasized that the strong Constitution has the control to deal with violence and aggression caused by faction which those in favor of democracy could not because of its instability government. Furthermore, in the federalist no.51 he stated that the Constitution’s separation of power also helps mitigate the problem of factionalism. Believing in pluralist theory that power is relatively broadly distributed among many more or less organized interest groups in society, and the fear of majoritarian rule, James Madison one more time convinced that the Constitution will mitigate the problem of factionalism by diving
He also desired equality and justice for all regardless of their religious or political affiliation but not through a government that had complete control over its people like an aristocrat would over “commoners.” Equality and protection of all citizens should be granted and protected by the government of America; a government elected by the people and for the people. Both men desired the government to have the common interest of the people at its cores, but had different ways of achieving it. Unlike Washington, who favored a centralized government, Jefferson opposed it. This created a conflict because Jefferson feared that the ideology of republicanism was threatened with a centralized and powerful government proposed by Washington as well as the supposed monarchical tendencies of Hamilton and the
Not every state agrees that gay marriage is wrong and illegal, but if the federal government were to pass a amendment outlawing gay marriage then every state who allows gay marriage would have to declare it unconstitutional and against the law. This shows that the federal and state governments have different restrictions. The state government protects the people of the state but the federal government protects everything in this country. Once something is declared unconstitutional, it will over ride any state government policy. Some people have mixed emotions about the way the government works but overall the relationship between state and federal governments protect the everyday
One group of proponents of the bill argued that the California Supreme Court did not have the right to rule the ban on same-sex marriages unconstitutional earlier this year. They said that Prop 8, rather, would ensure that the issue be democratically decided upon. But our founding fathers didn’t build this nation on a system of complete democracy, fearing the excess of the masses against minority groups. Instead, they created an electoral system and different branches of government to uphold the ideals of the constitution. This first camp ignores the historical dangers of allowing the majority to vote on a minority’s civil rights.
The long standing debate on whether amending the constitution to allow Naturalized citizens to run for presidency has formed arguments for and against the issue; all arguments stand with valid points. But as a democracy as the United States is, the government must consider the equal treatment of all its citizens including those naturalized. Loyalty to this country does not fall in place according to the country a person was born but by the values they were raised in. Not everyone has a realistic prospective of running for president whatever their background may be; but excluding certain citizens from consideration merely based on nativity is unjust and self-destructive. Kennedy states in his article “It makes second-class citizens of naturalized
They feel that the executive branch holds too much power, and having too much power could in fact be very bad and a threat. Anti-federalist were not as organized as the federalist, and didn’t take into consideration that checks and balances and such stop one branch from becoming too powerful. I learned more about he Bill of Rights. These are the first ten amendments of the constitution that were made limit the power of the United States Federal Government. This was mainly maid to protect citizens.
