One of the laws adopted is the “Three Strikes and Your Out” law passed by the state of California. For years, California had stood by and watch innocent people get brutally misused or murdered by these criminals. Until, one a little year old girl was kidnapped and murder by a repeated offender, which sparked state leaders to charge. The ethical point of view in this paper is to prove the utilitarianism concept of the law. Three-Strikes Law Three-Strikes Law In 1994, a very controversial, “Three Strikes” law was first passed in the state of California. The law forces state courts to impose of life sentence upon anyone who has been convict3d of two or more criminal offenses. This law is immoral, unjust, faulty, and should not be allowed anywhere in the United States of America. The law is immoral because it is putting people who have committed small crimes in prision for double life sentences when the situation could be easily resolved with community service or even a few life years in jail. For example, there was a “man [who was] sentenced to prison for 25 years to life under the law for stealing a bottle of vitamins” (Murphy).
The Swedish population feels that there are those who are dangerous to society and want them locked up securely; however, they also note there is a need "to stick with our philosophy of humanization" (Alvarez, 2005). The escapees, by the way, were soon recaptured but not before the resignation of the Prison Service director; there were also calls for the Justice Minister, Thomas Rodstroem, to resign but he remained in his position (Alvarez, 2005). He did however begin a "comprehensive review of Sweden's prison system," including plans to build a "bunker-style prison for the most violent offenders," though the idea has since been dropped (Alvarez, 2005). The escapes in 2004 were the first made "from Sweden's maximum-security prisons in a decade," and Alvarez suggests that they are due to a "change in the prison population" (Alvarez, 2005). Sweden's prisons, like those in the U.S., are filled to capacity and holding inmates who are "savvier, bolder, more organized and more violent than in the past" (Alvarez, 2005).

For years, the judicial system has complained about overcrowding and disparities within its jails and prisons. The push in the last few decades has been to find ways to deal with persons convicted of crimes and where to put them. Recent events in the United States have led to a number of calls for the abolition of conditional releases from prison.
In the republic of California, some would say we have some of the worst laws and restrictions in the country. Gun control on American citizens has been attempted ever since the Bill of Rights’ 2nd amendment said, “A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.” This sentence and its meaning have been debated by lawmakers and firearm-bearing citizens to this day, and we can not agree on what our founding fathers intended the amendment to mean. In my mind I see it only one way, the second amendment gives the people the right to own and keep any firearm they feel they should have. One point argued about the second amendment is at the end of the quote, it claims that our right to bear arms “shall not be infringed.” This phrase, however, is debated to whether they are talking about the right to simply own a firearm, or to place any limitations on firearms capabilities. The word infringed means to inflict upon a right or privilege.
They were either pursuing a better life, new opportunities, or just running away from a political system. Here they found peace, tranquility and opportunity for advancement — the so-called” American Dream”. Illegal immigration is one of the most controversial issues in the United States, but the new the Arizona law has provoked intense debate from Texas to Montana, drawing support in several polls and generating rejection by major civil rights groups. That is, Americans are trying to correct unlawful immigration dilemma with laws that infringe people’s freedom, liberty and equality. Although the federal government stills working on the immigration reform, according to Arizona’s law, it is a state crime not carrying immigration documents.
This angered Latino groups pushing him to make good on past promises to reduce deportations of immigrants living illegally in the country. Since Obama decided to abandon the immigration crisis, Rick Perry, the governor of Texas, decided to take this situation into his own matters. He believes that our borders should not be open and vulnerable to exploitation by ruthless criminals. He is focused on making sure drug cartels and other criminals don’t get a free pass into Texas and the rest of the nation because our borders are unsecured. Rick Perry then later decided to send 1,000 guardsmen to the border to assist the Texas Department of Public Safety’s “Operation Strong Safety”.
Serious offenses include all of the same offenses defined as violent offenses, and also include other crimes such as burglary of a residence and assault with intent to commit a robbery or rape (Prosecutors’ perspective on California’s three strikes law, 2004). In this paper, I will analyze and discuss the issues involved with “three-strikes” or habitual offender legislation. I will also discuss if the legislation should strengthened, cancelled, or modified in my state. For instance, since the placement of the Three Strikes Law in 1993, there has been a trickle effect on the criminal justice system due to the ineffectiveness of the Three Strikes Law. There has been a negative impact on public safety, county jails and state prisons, judge & juror as well as the cost that will be seen by tax payers now and in the future.
Citizens who voted no on Prop 34, wanted the death penalty still in action for those who commit extreme crimes. This topic has been a big argument for several years now, and even more do to the fact of California’s bad economy. The argument
- an incarceration rate unprecedented in U.S. History. Is incarceration in the US is one of the main forms of punishment for the commission of a felony and other offenses. When there are over a million people incarcerated throughout the United States, the ethical treatment of prisoner’s rights must be analyzed. Throughout the years many modifications have been made to accommodate inmates and preserve their human rights. We, as a society has done enough regarding this issue because the punishment don’t even fit the crime now.
