ADR Learning Team Charter Dora Lina Tovar Law531/Business Law March 29th, 2010 Marnita Robertson All disputes that arrive within the team that cannot be resolved within 24 hours will be handled through the ADR and the process of Mediation. In mediation “both parties meet with a neutral mediator who listens to each side explain its position” (Jennings, 2006). When there is a dispute, the learning team charter should be referenced to assure that everyone is following what has been written and agreed upon by the entire team. Any personal issues will not immediately be handled by the ADR but will first go through the team to determine if that person’s actions or lack thereof, are causing the team unnecessary work. Once it is determined that there is a dispute, within the learning team, each member has agreed to take part in the mediation process to help resolve the problem. The mediation process will include all members of the team, and one other neutral person who will help resolve the issue by giving the team different ways to look at the situation in a non biased way. The role of the mediator is not to make a decision, but to get the parties to agree on a solution (Jennings, 2006). In the event that the learning team cannot come up with an agreement to solve the dispute through mediation within 48 hours, the dispute will then be solved through arbitration.
