It is difficult to hold prosecutors accountable for acts of misconduct. Since prosecutors are often viewed as the “good guys” by the public, many times unethical, as well as illegal acts will be tolerated by the courts and criminal justice system as a whole. Prosecutorial misconduct is considered any action taken by the prosecutor in a criminal case that is against the law and/or unethical. Prosecutorial evidence can be anything from harassing witnesses on the stand, pressing unfounded charges against defendants, tampering with evidence, withholding evidence, up to taking bribes. Prosecutors can sometimes get away with misconduct as it is extremely difficult to prove that misconduct had actually taken place.
It is only through this broader understanding and exploration of the issues that an accurate understanding of the ‘crime problem’ can be obtained. The complexities and multiple perspectives on crime are not well understood by the public. This lack of understanding runs counter to the degree by which modern society is saturated by the subject of crime. It is almost impossible to live within our current society and not in someway be affected by it. We do not need to be an offender appearing in court or a victim of crime to feel its affects.
It's time justice put the emphasis of our criminal justice system back on protecting the victim rather than the accused. Any criminal on death row has almost always committed another crime to add onto their punishment. DNA testing and other methods of modern crime scene science can now effectively eliminate most uncertainty as to a person's guilt or innocence. Death penalty pros states that “DNA testing is over 99 percent effective. And even if DNA testing and other such scientific methods didn't exist, the trial and appeals process is so thorough it's next to impossible to convict an innocent person”.
Other methods like the National Crime Victimization Survey (NCVS), improve on several characteristics of the UCR but have their own errors and are subject to limited use (Maxfield, 1999). Steven Levitt (1998) points out that the issue of the validity of reported crime statistics is a hotly contested issue. Opinions vary widely on the significance of the problems connected with UCR data. Numerous researchers think that reported crime data is tainted from measurement errors coming from the vast differences in police department reporting in different jurisdictions, technological changes in crime recording and changes in crime reporting by victims ultimately. Even when such issues are present, it doesn’t affect the utilization of reported crime statistics for determining the efficiency of guidelines intended to diminish crime.
It was times where a suspect became very violent and the officers had nothing to solve the issue. They started to use stun guns and Tasers. White-collar crime is defined in terms of attitudes toward those who commit it. These crimes are punishable by law, however it is generally regarded by the courts and by sections of the general public as much less reprehensible than crimes usually punished by the courts.
However, this is not what happens. There are officers out there that break the law just as much as some criminals. They are paid to enforce the laws but how is it fair if they are not enforcing the laws themselves? It is not. The first step to corruption is using the wrong factors when they make decisions.
(Hallam et al. 2005: 56) Some crimes however are not reported because the victim may be intimidated by the person responsible for the crime, or they may not have faith in the police to pursue the crime if they do report it. Other victims of crime may not report it as they feel that the crime is too minor, or that the police will think it is too minor to pursue. A large amount of sexual crime goes unreported because the victim is either too shocked, afraid or embarrassed. Police can use their discretion as to whether or not an incident is worth reporting, they have to decide if the incident is serious

Death Penalty Should Not Be Abolished Criminals who are not afraid of being equally punished for their horrible crimes have murdered many people every year. Career criminals make it impossible for the average person to live their life without fear. Since most states have eliminated the death penalty murderers, dangerous criminals cannot be sentenced to the death penalty. The way the justice system works in some states is not fair compared to the other states that do have the death penalty. Therefore, the United States interprets the same human right differently depending on a location.
