To what extent, if at all, is recognition significant in determining whether or not an entity is a state or not? Provide examples. The Politics of International Law INR 6210 By: John Doe At the start of the 20th century, there were a mere 50 countries in the world and before WWII, the number jumped to 75. A century later, the number is getting to more than 200. This inclusion of states to the international community has been unprecedented on a wide scale and has been experienced by every corner of the globe. The transition of an entity to a state is a very complex and a lot of the time very political. One of the most important questions in determining whether or not an entity is a state or not. This paper is going to look at whether recognition is the determining factor in if an entity becomes recognized as a state of not and if recognition is important at all. In International law, a state must poses the following to be considered a state on the international arena: “1. A permanent population; there must be some people to establish the existence of a State but there is not a specification of a minimum number of people and again there is not a requirement that all of the people be national of the state. 2. Territory; the second qualification is territory where the permanent population live on. 3. A government; A State requires a government that functions as a political body within the law of the land. But it is not a condition precedent for recognition as an independent State 4. The capacity to enter into relations with other states; the fourth and last qualification is about independency, in other words independence is indicated by the criterion of capacity to enter into relations with other states.”[1] There is a
