Role and Functions of Law According to Melvin (2001), the word law is defined as a body of rules of actions or conduct prescribed by controlling authority, and having legal binding force. In this paper I will discuss the functions and roles of the rules and conducts we know as laws in business, society and in my current industry of Electronic Funds Transfers in banking. Functions and Role in Business and Society The law has similar in business as it does to society. The primary functions of laws in both are to maintain order and fairness. It maintains the order by contain and control actions performed by individuals and corporations by punishing the offenders with fines and/or jail time for their violations. In a business environment, the law has a few additional roles and purpose than it does to society. The law as expanded into how businesses interact with their employees. Such actions are hiring, firing, and treatment of their employees. The law also has rules and procedures as to how the businesses conduct their internal and external affairs. The reasons for the laws were to assist the businesses with opportunity for growing and expanding their businesses while limiting their risk. Many of the laws were written with the employers’ assistance. The role and function of the law in society incorporates many of the laws that were written for businesses. This is because the businesses employ members of society. Laws such as employment and labor laws were written to protect both the individual and the business. Another law that incorporates both businesses and society are consumer protection laws. These laws, much like other laws, are writing and up held in different areas, state and federal. At times the state law can be different than the federal law. In this case the federal all surpasses the state law. An example of the federal law overriding a state law
