Is it just to hate on a different group of people? Or Should Freedom of Expression be take advantage of? James Keegstra who works as a high school teacher is a model of these questions because he promotes hatred towards a group and then challenges the court with freedom of expressions. Teaching his theories to student created a disadvantage to him therefore by doing all this He was charged under s. 319(2) of the criminal code. He had used the charter of rights and freedom to support his actions and using freedom of expression against the court to its limit was one of his main arguments. James Keegstra who was also an auto mechanic and a former mayor lived in Eckville, Alberta. Was charged under s. 319(2) of the criminal code which states that any statement which promotes hatred towards an identifiable group is considered guilty unless in a private conversation. He gave anti-Semitic statements to his students which promoted hatred towards a different group of people. James had told his students that Jews are “communists”, “imposters” and more and he taught them that Jews were “money lovers”, “power hungry”. He taught his classes that the Jewish people are the reason for depressions, chaos, war and revolution. James described Jews as people of profound evil and that they had created the Holocaust to gain sympathy. He made these statements to mainly attack Jewish people and He would also test his students on his theories and understanding, students who agreed to his theories would get better marks then students who disagreed towards his theories. This was unfair to the kids who did not believe in his theories. James Keegstra attempted to quash the charges as he believed it violated his freedom of expression. He applied to the court of Queens Bench but the court declined his application and he was convicted at trial. His students testified against him, the
