Whereas on the other hand the Conflict Model of the contemporary criminal justice system refers to a model of crime where the criminal justice system is seen to be used by the ruling class to control the lower class. It argues that the organizations of the criminal justice system should work competitively to produce justice instead of cooperatively. The American Prison System The fear of going to prison strikes fear in some and in others, it is an opportunity for rehabilitation and a chance to reflect. The magnitude of punishment is currently dependent on the location of the crime and trial as well as the prison where the offender is sent for their punishment. The privatization of the prison system and the lack of efficient and effective punishments through out the United State’s prison systems have left our prisons overpopulated, under funded and mismanaged. Creating standard guidelines throughout both public and private prisons, as well as making uniform punishments that fit their crimes, will make a transfer to a private prison no different than a stay in a publicly funded prison.
Cruel and Unusual Punishment Kristin Mara Southern New Hampshire University 1 June 2014 Graeme Newman’s theory of the “just and Painful” Graeme Newman’s book “Just and Painful” discusses the confusion on punishment in the prison system. He discusses that there should be corporal punishment but by design. There needs to be a structured system on how criminals pay their dues for the crime committed. A person accused of a vicious rape should not be equaled to someone who stole from a grocery store. But unfortunately when they are sent to prison they both are humiliated and somewhat tortured to the same degree.
One penalty that can be applied during the sentencing process is imprisonment/gaol. Gaol is one of the key penalties imposed during the sentencing process. Gaol is the detention of an offender for a specified period of time. There are a number of levels in the gaol system including open prison farms, minimum security, medium security, maximum security and super max. Gaol plays a significant role in achieving justice for society and victims as it incapacitates the offender so they cannot reoffend, provides a serious punishment for serious offences and keeps dangerous criminals off the streets.
Interpersonal violence is a big threat to inmates and jail personnel. American jails are faced with the threat of overcrowding, and the threat to the society criminals who have been set free. Better prison management methods are able to solve the issue of overcrowding in jails. Violence against staff by prisoners can be addressed by having only experienced staff to oversee the jails. The threat that former inmates pose to the society can be addressed by better rehabilitation
Every individual has their own impression and ideas as to how a law breaking individual should be treated in prison and after being released from prison. Many believe that there should be a permanent stigma and others believe that they should simply serve their time in prison. I believe that when the time is served that the individual has done their part. However, if the individual has done a sexually inappropriate crime I do believe that they should be permanently l labeled for societies
