Parliament can make laws on any matter due to Dicey in ‘Law of the Constitution (1885).’ He said that ‘in theory Parliament has total power. It is sovereign'. He states a number of reasons as to how this is possible. Firstly Dicey points out that Parliament can pass laws on any subject without legal restriction therefore it is sovereign. This principle is a result of the election of the Members of Parliament (MPs), by the electorate which gives them authority to represent and pass legislation on their behalf.
The Australian parliamentary system is based of the British Westminster system, which was adopted in the Commonwealth of Australia Constitution Act 1900 (UK), known as the Commonwealth Constitution. The Commonwealth Constitution established the Commonwealth Parliament and outlined its law- making powers. The Bicameral System The Commonwealth and state parliaments operate on a bicameral system, which means two houses: an upper and lower house. Queensland and the territories are exceptions to this rule and only have one house each. If our founding fathers intened the Constitution to establish a republic government, why are we so quick to respond that our government is a democracy? Does our misunderdstanding of these two terms make citizens believe that we are entitled, by the supreme law of the land, our Constitution, to make decisions and write legislation ourselves instead of allowing our elected representatives to act on our behalf? Should the Constitution be ammended to allow for a national voting referendum such as many states have adopted? In the paragraphs below I will discuss and define some key points that will give a broader persepective on the benefits and limitations of direct democracy. Historians who follow this interpretation believe that the Revolution was for the purpose of creating a natural rights republic, a government whose main responsibility is to protect its citizen’s inalienable rights, life, liberty, and property. A natural rights republic stems from the ideas of John Locke, saying that a legitimate government is one that’s power derives form the consent of the government; these radical ideas are demonstrated in The Declaration of Independence (Gibson Lecture). In the summer of 1776, the Declaration of Independence published by the Continental Congress, issued American independence from Britain and justified their actions to do so. The Declaration consisted of four parts: an intro, philosophical content, a list of grievances, and the declaration itself. In the introduction, the framers blatantly stated, “all men are created equal”, while discussing the citizen’s unalienable rights and the importance of consent of the governed.
