Unit 17 P1 Unit 17 P1 Warrantless Arrests Generally, an officer may make an arrest in a public place without a warrant if probable cause exists. Probable cause in this scenario does not require the approval of a judge or magistrate, rather it may be derived from reliable tips, a routine vehicle stop, a "stop and frisk" or any additional evidence that an officer observes. Also, an officer may enter private property to make an arrest, but only if "exigent" or emergency circumstances exist, such as the safety of others or even the suspect himself. Warranted arrests To obtain a warrant, probable cause would have to be presented to a judge there would be evidence and/or testimony to support the warrant. An arrest without a warrant would be one that someone, usually an officer, caught someone in the act of committing the crime.
Police are said to have a “we-they or us-them” worldview. This in-group, we (police) v. they (civilians). Solidarity is associated with the idea of police subculture, but in practice the more general term culture is commonly used to describe everything police share in common. Not many have an accurate understanding of what police officers go through while working in high stress and dangerous environments. Police officers are taken for granted and people rarely think of the personal, mental, and physical sacrifices that police make in order to protect our community.
The driver could lose control of the car due to technical problems or weather conditions, an accident could happen because of other driver’s fault, breaking driving laws could cause unsafe situations. Yet so many deaths could be avoided by doing something as simple as putting a seatbelt on when getting into the car. Laws is not something too many people care about, but it is illegal in most states to drive in a car without having a seatbelt on. Not wearing a seatbelt may injure and even kill the driver and the passengers in case of an accident. Also, not being buckled up may cause injuries and deaths to people different from the ones not following the rule.
Therefore, many countries today have prohibited certain use of hand-held devices while driving because of the personal safety and the safety of others, dangers associated, and causes distractions which could lead to death. Just like you put yourself and the safety of others while driving drunk, the impairment is very similar to when using a cell phone when driving. This does not mean people should start drunk driving but indeed means that driving while using the cell phone is just as bad or even worse than drunk driving which is unacceptable. Both hand-held and hands-free cell phones impair driving, with no significant difference in the degree of impairment. Banning hand-held devices will not necessarily improve our safety and of others if drivers simply switch to hands free phones.
However there is matter of environment and jurisdiction that gets in the way. A private property such as a parking lot or apartment complex can be limiting to police. Their authority in some circumstances is next to none, however if these facilities employ private police, their authority cannot be denied. Private police today are often given the many of the same duties as a public police officer. However, thanks to the fact that the private police do not work for the government,
Using a cell phone while driving is a very dangerous obsession to do. I believe that there should be a law in every state banning the use of cell phones while driving. If a person uses a cell phone while driving he or she is easily distracted. It is one of the major causes of traffic accidents. Using a cell phone while driving also lowers a person’s reaction time.
“A formal justice system is one in which laws are set and enforced and punishments are administered by state institutions such as courts, police, judges and prisons” (Ask.) A justice system can possibly encourage deviance and crime because there are some people who do not like to follow the law. An example of this behavior can simply be driving under the influence of alcohol. In our society everyone knows that it is against the law to operate a motor vehicle in this condition but yet there are so many people still doing it. Crime will always be committed as police are not always looking over people’s shoulders to ensure people will not break the law.
No matter how careful a driver you may be, when you do something else while driving, whether its drinking coffee, listening to music, scanning the GPS, or making a phone call, you endanger the people around you, and including yourself, because you are distracted from your driving. An accident needs only a couple microseconds to occur. Even though no state can ban people for changing radio stations or applying makeup while driving, all states can, and should, make it illegal to drive while talking on a cellular phone. Since the rise of popularity of cellphones in the past years, the number of accidents caused by people talking on their mobile devices has also increased. Whether they were in an argument, receiving a message, or simply dialing a number, they were momentarily distracted from the task of driving.
This law would minimize the number of accidents that occur, I do believe. If cell phone use while operating a motor vehicle was against the law, I do believe it would only be far if the computers in a cop car should also be illegal. I say this because most of the time cops are focused on the computer and if they weren’t distracted by the computer they would also be able to prevent accidents that occur because of speeding. Another reason to adopt the law of cell phone usage while operating a motor vehicle would be because texting is against the law and we as citizens are required to follow the laws. It is overall dangerous to talk on the phone, and or text while operating a motor
Many accidents occur due to cell phone use because the majority of people are not able to do it safely (2009). It is common for people to not be focused on the road or other drivers if having a conversation while driving. Just as when impaired, the use of a cell phone while driving can slow down your response and reflex time. Most people are over confident about their capabilities of driving while using a cell phone, just as those that think they are okay to drive while they are impaired. Some states have banned the use of use of cellphone use unless used with a hands free device and some states banned texting while driving.
