October 2, 2012 Case Brief Cupp v Murphy 412 U.S. 291 (1973) Facts: Daniel Murphy was convicted of murdering his wife in the second degree. After he found out of the murder he called the police and voluntarily submitted himself to questioning. In the middle of his questioning the police noticed a dark spot on his finger and they asked if they could get a sample and he refused. The police did not respect his wishes and they took the sample anyways of what was under his fingernail. They processed it and later found out there was traces of his wife’s nightgown, skin, and blood all from the deceased victim.

In April, 2001 convicted-offender database got what was called a “cold-hit” because the perpetrator of the crime had been convicted of shooting at a residence that was occupied, which in North Carolina requires that the persons DNA be placed in the criminal database. He was brought in for questioning, served with a search warrant and a blood sample taken. The blood was analyzed and a match was made to the DNA of the perpetrator the authorities had named the “Night Stalker”. This month Kip Kinkel was sentenced to life in prison in Oregon for the murders of his parents and a shooting rampage at his high school that killed two studen ts. He is serving a 70-year sentence for luring a n 11- year-old boy named Eddie Werner into his New Jersey home and strangling him with the cord of an alarm clock because his Sega Genesis was out of reach. Woloscuk CJS/211 Ethics in Criminal Justice October 6, 2014 Melissa Andrewjeski Murder of Daughter and 6 Grandchildren On September 18, 2014, 51-year-old Don Spirit murdered his daughter, Sarah Spirit, 28 and his six grandchildren. 11 year old Kaleb Kuhlmann, 9 year old Kylie Kuhlmann, 8 year old Johnathon Kuhlmann, 5 year old Destiny Stewart, 4 year old Brandon Stewart and 3 month old Alanna Stewart. He then called 911 and said something about harming people and himself. Deputies arrived and he committed suicide. They don’t know the motive and probably will never know.
“WET”, A CONTINUING TREND THAT NEEDS TO STOP 31 year old Osvaldo Rivera of Camden, New Jersey was arrested for the September 02, 2012 deadly stabbing of his two children, Dominick Andujar 6 years old and his sister Amber 12 years old. Two other children in the home were uninjured in the attack. According to police Mr. Rivera was high on marijuana and PCP when he fatally stabbed his son and critically injured his sister while they were asleep. Upon arrival to scene by officers, witnesses heard the screaming of a young girl stating her younger brother needed help. Mr. Rivera was not present at the scene and was later tracked down by information given from several witnesses.
Robert Lee Stinson was convicted in 1985 of the murder of a 63 year old Milwaukee woman the previous year. She was found at her residence the morning after being dropped off at home from playing bingo. She was partially nude, had been beaten badly, was bloody, and had numerous bite marks on her body. Stinson was arrested by a police officer when the officer stated that his teeth matched the bite marks on the woman’s body. At the trial, two forensic odontologists testified that Stinson was a match for the bite marks even though the bite marks showed a tooth where he was missing one in his mouth.
