Individual Rights and Public Order Criminal Justice 101 by: Daniel S Eaton The merits of individual rights for us as Americans is basic natural rights. Life, liberty, and the pursuit of happiness. Our Constitutional rights as Americans, especially the first ten amendments or The Bill of Rights, are the most important of our individual rights and without these rights that were written for us by our fore fathers we would most likely still be living in the fashion as they were before the constitution. In my own opinion individual rights are important because I like knowing that the government isn't going to come break down the door of my house just because they want too. The fact that due process must be involved and there must be evidence before I can be hauled off to jail and left there. On the other hand sometimes the safety or good of the many definitely out weighs the needs of the few. Public order helps to keep us safe from threats of terrorism and criminal activities. Without it we might be subjected to all kinds of ramifications within our society. There are times when individual rights must be sacrificed in order to maintain our American way of life. The balancing act of these, individual rights and public order, is a continuous ballet within itself. There are many times, and will be many more times, that our society has swayed one way or the other. This is all depending on the moment, and what is contained in that moment. Different situations call for a sway either to the individual rights or public order sides. At this moment in our society we are more on the public order side. For example due to the September 11, 2001 attacks we now have expanded our nations law enforcement agencies and added extra security at our airports and borders. We as Americans have given up a few of our individual rights and are now being searched just about
