The discussion could be is that criminals are being handled well, but some say that they are not being handled like criminals. However, when you think back many years ago, criminals had no rights what so ever. The wardens ran the prison as they saw fit. As for the criminals back in the day, they would be taken out and stoned, beat, and even killed. But with the ethical treatment of criminals these days has a gentle and healthier living circumstances.
The Treatment of Inmates Samantha McAnally Abstract This paper will be discussing how the prison system, the guard and each other treat inmates. Through a practical view, the argument could be made that these prisoners are being treated to good and not good enough. The society can consider a comprehensible, hypothetical groundwork towards an ethical decision-making concerning the inmates. People should come to a concrete conclusion upon a course of action before making a decision on how to punish them. The Treatment of Inmates When there are millions of people incarcerated throughout the United States, the ethical treatments of prisoner’s human rights require examination.
As time passes are prisons are becoming over crowded forcing are government to create new sentencing options to deal with this problem. Instead of sending convicted offenders to straight to prison the government has come up with the following options for judges to choose from that would fit the crime best; they are absolute discharge, conditional discharge, a fine, suspended sentence, probation, conditional sentence, imprisonment, and intermittent sentences. First of all before the judge make a choice on a particular sentencing option they need to consider whether the sentence would be in publics best interest, which is because the main reasons behind corrections and the criminal justice system is public safety, and the second thing they would need to consider is if the offender is given a community sentence is he going to re offend and if he does would it be a violent crime.
When someone has been in prison for so long and they are not properly rehabilitated, they go back to prison because it is how they know life to be, like it is there home. the combination of repeat offenders and new offenders leave the prisons overcrowded and dangerous. Prison is suppose to be a form of punishment and rehabilitation, not a way of life that is welcome. These inmates are seeing it as a way of life because it is so overcrowded, they are not taught any
In the Stanford Prison Experiment and the events with occurred at Abu Ghraib, the guards weren’t trained to be guards of any sort. The guards weren’t given set of rules to of how to detain the prisoners; therefore, they were to be creative in regards of doing their job effectively. In both situations, the guards resorted to sadistic and inhumane forms of torture to keep the prisoners in place. The guards didn’t have any history of psychological problems or violence prior, but it’s shocking what type of measures the guards went to because of their environment and power trip. For the prisoners, they became depressed, psychologically distraught, dehumanized, and powerless.
If a regular citizen committed the crime they would receive time in jail for whatever crime in which was committed. Justice concerns the proper ordering of things and persons within a society (Dictionary.com, 2009). The concept justice has been subject to legal, theological, and philosophical reflection and debate all through the history of time (Dictionary.com). Justice is to do what is right and punish the ones who have done wrong. Justice is to maintain order and to punish the criminals in which have committed the crime.
Privacy for the individuals who are in these facilities has many concerns to keens that are searching in from the outside. Health problems and concerns for prisoners and disregard that happens in correctional facilities have been worries that press on to go unnoticed. The state appears to under staff in a few territories of administering prisoner's health issues. There are numerous who might go unattended of their health issues creating radical or even death in the process. Being in Jail is known as a booking where the person stays in jail while the next couple of steps to the process take place. Shortly after put in jail a Bail hearing takes place where the suspect is given a certain amount of money that can be paid off in order to get out of jail until the trial takes place. In this case, the gunman was not granted a bail because the judge did not believe that he would go to court on his given date. Every ethical theory has its own unique way on looking into issues. Utilitarian stands out the most to me because it stands for the belief that moral rules should be choices made by a society to promote the happiness of its members. Through the utilitarian view the argument could be made that these prisoners are being treated to good and not good enough. If this theory was utilized within the jail system many issues would be solved and go along with the right and not wrong.
