This is to include researching current legislation which pertains to the counselling profession. You must explain how The Equality Act 2010 has replaced specific legislation. Briefly describe the individual legislation relevant to a counselling context which the EA 2010 replaced [2.1]. You must assess the relevance of these acts in relation to the counselling relationship/practice [2.2]. [2.1] Equal opportunities are a concept that refers to a fair and just treatment of all individuals no matter of their ethnic origin, gender, religious persuasion, disability and sexual orientation. Theoretically equal opportunities ensure that there exists equal opportunities amongst the population for health treatment, education and employment. Government legislation exists that ensures equal opportunities are respected and that individuals are not discriminated against. There are essentially two forms of equality; formal equality and substantive equality. The Equality Trust defines formal equality as “The formal approach to equality and non-discrimination supports the position that a person’s individual physical or personal characteristics should be viewed as irrelevant in determining whether they have a right to some social benefit or gain. At the heart of most protagonists’ defence of this model is the principle of merit.” (Equality Trust 2007 2).
