Our justice system shows more sympathy for criminals than it does victims and this should be altered. It’s time we put the emphasis of our criminal justice system back on protecting the victim rather that the accused. This is to let people know that the punishment always far outweighs thecrime. For example, one method is to embarrass a young person because they committed acrime, or to tell them that eventual embarrassment is part of the punishment before theyeven commit the crime. I think that general deterrence is the most effective way to handle young people andcrime. This tells the young person know, well before they commit a crime, that they will be caught and punished, which prevents them from committing the crime at all. The other methods handle individual problems.
I think that trying to rehabilitate a very violent person is a waste of money. I also believe in the three strikes policy. If all states were harsher on criminals of violent crimes and all states had the death penalty maybe that would make these criminals choose to stop doing such violent crimes. In most juvenile homicide cases, they are automatically put into the adult justice system for committing the adult-like crime. Some of these children are receiving punishments such as life in prison, even life in prison without parole. Although, the kids may have committed the “adult” crime it is unethical for youths to be tried as adults. Some crime are committed that society want to see the juvenile be locked up and the key to be thrown away. This mentality makes rehabilitation programs hard to be supported and punishment seem almost manditory. The fact is that juveniles need the second chance because an adult life is much longer than an adolesent life and adolesents make mistakes out of emotion not logic. By reserving the ultimate penalty of death for those who wantonly kill, we are clearly proclaiming our special reverence for life. It is society’s ultimate means of selfdefense. The death of a criminal can certainly be justified if it prevents the future deaths of innocent victims. Since death is the greatest punishment a society can impose, it stands to reason that it is the most powerful way to deter those who would commit a crime. Economist Isaac Ehrlich compared the murder rate in the United States with the rate of executions between 1933 and 1967.
They lied about getting a warrant and in turn let a killer walk away from the situation with no punishment. Like I said previously if they would have used the ethics of virtue system they would have went about things in an honest manner and even though it might not have saved the life of Detective Griffiths it would have put his killer in jail. Ethics training for our officers is very important to maintain order (Papenfuhs,2011). However, when really spending some time and thinking about this situation I wish our legal system could in some way take into account the pressure we put on cops and when we know for an absolute fact a serious crime as been committed that the criminal could still be punished regardless of the mistakes of cops. Due to the amount of appeals and thorough investigation of each case, no piece of evidence is overlooked for the benefit of the defendant. Unless there is strong criminating evidence and the court is certain the accused is guilty, the death penalty would not be issued. For the 2,293,157 behind bars in our country the miniscule 3,220 on death row is unlikely to contain innocents due to their case being examined extensively. If one innocent man was wrongfully put to death by the state, should we abolish the death penalty? This argument can be compared to if a police officer shoots an innocent man, the country should purge police officers of their weapons.
A kid is no longer a kid when he is able to just to act upon his thoughts of killing someone. Juveniles offenders that are committed a crime should be tried as adults if only due to murder or hurting someone physically, if the offenders have the mind enough to take someone’s life, then they also have the mind enough to set in prison and think what they have done. But when it comes to crimes such as, stealing, being caught with drugs, or other crimes have to depend. Without this law we have in place right now the world would have fallen on its face drastically. The Criminal Control Model basically puts it in a way where if you are arrested you are basically innocent until proven guilty. It follows the rule in which other laws do not, such as the due process. The Due Process is mainly focused on the offender’s rights.
