Capital punishment for murder is based on the idea: that if a person kills someone; he must pay with his own life. So, death penalty is usually imposed because of some type of gross misconduct. The first death penalty laws were established in Eighteenth Century B.C. Something new appear in the world has its own reason. Maybe the new law can make contribution to the society. The United State uses the death penalty over the past four centuries. They are from the seventeenth to twentieth century, and a peak of executions was used in the early 20th century; moratorium; and finally, a trend toward more executions in recent years. United States abolitionist movement begins in the Late 1700s. The society system change and it can make the changes in many aspects, such as law, economic, and so on. So the abolitionist movement made some influences to the death penalty system.
The first recorded death sentence in the British North American colonies was carried out in 1608 on Captain George Kendall, who was executed by firing squad at the Jamestown colony for allegedly spying for the Spanish government. The Espy file, compiled by M. Watt Espy and John Ortiz Smykla, lists 15,269 people executed in the United States and its predecessor colonies between 1608 and 1991. 4,661 executions occurred in the U.S.   And in 1930s, executions reach the highest levels in American history; it is about average 167 per year. However, in the real society, different people have different opinion to the same questions. There are many arguments in the advantage and disadvantage to the death penalty. In 1948, the United Nations General Assembly adopted the Universal Declaration of Human Rights proclaiming a "right to life." That means death penalty would have an argument to be supported or against. They argued about whether the statute mandating the death penalty is unconstitutional.
