During their trial, prosecutor Nick Rice informs Clyde that DNA evidence incriminating Clarence has been deemed inadmissible due to botched forensics because, according to Nick, the actions of the police at the crime scene affected its solidity in court, and that Clyde's testimony alone is insufficient to prove either suspect's guilt. Nick, interested in maintaining his high conviction rate, strikes a deal: Clarence gives testimony that will send Rupert to death row, and in exchange Nick allows Clarence to plead guilty to third-degree murder, for which he will only serve three
Months later, Unexpectedly Joe Dick, Daniel William’s roommate is now suspect number two. Ford immediately started his cruel interrogation, pushing the death penalty on him. October 2, 2012 Case Brief Cupp v Murphy 412 U.S. 291 (1973) Facts: Daniel Murphy was convicted of murdering his wife in the second degree. After he found out of the murder he called the police and voluntarily submitted himself to questioning. In the middle of his questioning the police noticed a dark spot on his finger and they asked if they could get a sample and he refused. The police did not respect his wishes and they took the sample anyways of what was under his fingernail. They processed it and later found out there was traces of his wife’s nightgown, skin, and blood all from the deceased victim.
This case proceeded in London and was said to be a strong influence in the abolishment of capital punishment in the United Kingdom. Evans was executed in 1950 for the murder of his wife and 13-month-old daughter. Evans maintained his innocence through the whole trial and told investigators that his neighbor, John Christie murdered his family. There was not much evidence against Evans and the case was said to be really weak but he was still executed on March 9, 1950. The police coerced Timothy Evans into a false confession by threatening him.
The then-28-year-old claimed Holly had accidentally drowned after falling into the bath at his rented cottage as he tried to treat her nosebleed. He also claimed to have accidentally suffocated Jessica while trying to stop her screaming after she witnessed the incident. However a jury failed to believe his lies and following a six-week trial at the Old Bailey, Huntley was found guilty on both counts of murder and sentenced to life imprisonment. Upon a search of the car, Denise Fox’ severed head was found in his trunk. As far as errors in the evidence go, well ten months later, authorities dropped all charges of Amolsch’s, when the man who said he had spotted Amolsch’s van outside the mobile home was arrested for raping another woman in the same trailer park. So disagreement did spread, but Warnick never did rule Amolsch out as the maker of the mobile home bite mark. Yes, in the Amolsch case, one death did occur, and that was the death of Jane Marie Fray at her mobile home in South Michigan. The manner of death was a clear Homicide because the victim was murdered. The means of death was a knife because she was stabbed twenty-two times all over her body, and it was also an electrical cord, which the killer wrapped around her neck.
That evidence along with letters he wrote to Carr and the Cassaras, his military background, his appearance, and an arson incident, led police to his door. When he was arrested he immediately surrendered to police and identified himself as Sam. After being evaluated, it was determined that he could stand trial.
