Unit 3 Case Study Presented in Partial Fulfillment Of the Requirements for the Class LS 311-Business Law 1 By Michael Mc Evoy Kaplan University 5 June 2012 In the case of Makoto’s laptop which was stolen we are asked to identify the different types of crimes that have been committed. 1. While passing Makoto’s house one night. Sarah sees a laptop computer left unattended on Makoto’s porch. Sarah takes the computer, carries it home and tells everyone she owns it. – This would be theft there’s one victim and she was not held in duress or even had knowledge of the crime being committed. It is not Sarah’s intend to harm Makoto just to steal her computer when she’s not looking. 2. While passing Makoto’s house one night. Sarah sees Makoto outside with a laptop computer. Holding Makoto at gunpoint, Sarah forces him to give up the computer. Then Sarah runs away with it. – This would be Armed Robbery, Sarah has the intention to inflict bodily harm to Makoto should he not comply with Sarah’s request to turn over the computer. Sometimes Armed robbers are bluffers but the prey on the fact that you are not going to call their bluff. When you attempt armed robbery it can escalate real fast to more capital crimes including murder. 3. While passing Makoto’s house one night Sarah sees a laptop computer sitting on a desk near a window. Sarah breaks the lock on the front door, enters and leaves with the computer.—this would be breaking and entering. All of the home invasion burglaries are B&E’s (Breaking and Entering) the case with this is that you have to ensure that the homeowners are not at home when this happens. I don’t know about other states but here in Georgia should someone break into my house it would be the mistake of a lifetime, due to the fact that when I shoot I shoot to kill. Most of the time this is a crime of opportunity.
