The employees who tried to bring these practices to light where quickly terminated or pressured into cooperation. Had a large number of christian employees been present in these internal control departments, the whistle would have been blown sooner and more often. Christian ethics are based on faith, they do not allow for wiggle room and cannot be influence by the pressures of corporate culture. Management promoted the manipulation of their earnings, in order to make their stock look more attractive to investors, which ultimately helped Fannie Mae reach their corporate goals. A false balance is an abomination to the Lord, but a just weight is His delight.
The burden is on the employer to prove a BFOQ, and it is a difficult burden. The BFOQ defense is available only in cases of discrimination because of: Religion, Sex, National origin, and Age. Although a section in the law states, that Discrimination is OK "in those certain instances where religion, sex, or national origin is a bona fide occupational qualification reasonably necessary to the normal operation of that particular business or enterprise. As stated above, Hooters and LeVeille Maison’s business depend strongly on the experience offered to their customers. Under the BFOQ, the reason behind why they did not choose to hire Mr. Garcia or Mrs. Cameron, is covered and completely reasonable.
Economic Issues Simulation Paper Heather Pennington University of Phoenix Mark Williams HCS/440 Making financial and economic decisions for a business is never an easy task. It is a lot harder because employees have to know what is best for the business in order to profit from it and grow larger. There are three types of Castor plans which are Castor Standard, this covers any incidentals but will not cover any pre-existing health issues. Then there is Castor enhanced, this covers pre-existing health issues and then there is Castor enhanced minor which covers pre-existing health issues and coverage such as obesity, substance treatment, etc. can be excluded and this include mental health.
If a company’s internal controls are not working properly customers and investors will be more doubtful and have second thoughts on their investments and money being safe which will lead to having less investor and the stocks will drop. It is very important for companies to have their internal controls up to date and making sure they are working properly because this can cause major setbacks financially. But there are some instances were internal controls cannot even stop unethical behavior from happening such as shoplifting in a shopping mall or even a bank
The stress of the audit partner is tremendous and choosing that profession is one that I would prefer not to undertake. The anxiety and pressure to certify that a company’s financial records are in good standing can be daunting. 3.) Independent auditors are sometimes perceived as the “necessary evil” by corporate executives because of the possibility of exposing corruption. To change this point of view an auditor can try to explain their intent to educate and improve the company’s policies, which can in turn lower costs.
Besides state and federal regulations new companies are developed with new policies making it much harder for just anyone to open up a facility. Not only do they need to be approve but adding employees whether physicians or assistants must be an attractions to keep any other competition on the low. Due to so many restrictions helps keep the opposition on the low side. In the health care filed the bargaining power of buyers is also very narrow and restricted. The economy has no control over humanity, the reason for this will be since diseases, illness and injuries occur during any giving time.
Licensing is supposed to create a boundary in separating people who know how to do the job from people who do not. Young (2002) argues that occupational licensing has many flaws. He stated that it raises prices and does not prove concretely that having a license insures better quality or safety. Also, the requirements usually do not insure “good practice.” The law places more attention to non-licensed practitioners than licensed practitioners who malpractice. Occupational Licensing requires schooling, courses, training, and other obstacles in order for people to practice their specialty.
The former employee, Pelvas, complained to the EEOC that the mandatory services are in conflict with his beliefs. One of the defenses that Townley used was the “undue hardship” if they accommodate religious beliefs of Pelvas, which would excuse him from attending the religious services. Townley lost in this argument because the court did not see undue hardship happening for the company if they not allow Pelvas to attend the services. For our situation, we can win in this case because our claim of undue hardship is valid, unlike the Townley’s. We needed this shift change because of business necessity.
The shaven beard example in the simulation uncovered a conflict between the rules of the company and religion expression. The example regarding the beard may not always be acceptable in certain situations, and a company may have to make some adjustments to deal with particular situations that arise. These adjustments could make it easier to comply with the foreign country’s requirements and make conducting business in that country more pleasant. This also helps to protect companies against any claims of discrimination. International problems regarding business law, in this week’s simulation, are similar to those presented in week one’s reading regarding domestic issues of business
Citizens bicker, complain, and protest; yet do not vote. Many would probably say, “It is not a legal responsibility to vote, so why should I?” or “My vote does not count and it will not change anything.” For many years, these have been the thoughts of a multitude of people and their reasons why they do not vote. But let us not be brainwashed. Voting is not only a responsibility; it is a duty. Citizens should be encouraged to embrace their citizenship, and not merely as a duty, but as a meaningful opportunity to participate in their own government for the sake of common good and in building the culture of life.
