The federal courthouse doors should be reopened to state prisoners, particularly on the death row; the reason is that justice should not be short circuited. After the appellate options are exhausted, the writ of habeas corpus is an important option in capital punishment cases. The writ of habeas corpus has revealed irregularities and deficiencies in about 70 percent of the cases. The persons on the death row should have the facilities of having their cases reviewed a multiple number of times in case that is a wrong conviction and the person that is convicted is innocent, for example:
On March 31 of 2004 the international court of justice order United State to review the cases of more than 50 Mexicans held on death row because the court understood that their rights was violated. The court stated that United Stated Authorities prevent the prisoners from contacting officials from Mexico to help them defend their self. The international Court make the argument that the United State had breached the 1963 Vienna convention witch states that the US should provide meaningful review of the conviction and sentence of prisoners. Also it stated that any person accused of a serious crime while in a foreign country are given the right to contact their own government for help. (Amnesty International USA, 2008)
The death penalty is such that it is irreversible situation that In short, the legal system should provide innumerable opportunities for reviewing the cases of death row prisoners so that no innocent person is administered the death penalty. In an ideal situation, this opportunity of reviewing cases should be available to every prisoner. However, this is not practical. The reason is that the caseload of the federal courts becomes very heavy and the value of the final determination of guilt is diluted.
The administration problems should not have precedence over justice and especially justice in which the death sentence is administered to the convict....
