Clubs legal issues
The club seems to have quite a few fundamental issues at hand, the first is the contract between Raj and themselves. Within this issue several legal issues are raised. The First is the legality of the contract, and secondly the exclusion of articles withheld. Another legal issue raised is through Raj’s instructions, his agent begins to secretly negotiate a new contract of employment between Raj and a large mixed hockey club in Queensland for a period of 3 years receiving $150,000 p.a.
Raj also begins to play some informal games of mixed hockey on his days off and fails to inform the club creating another legal issue by breaching the contract.
Raj also breaches his contract with Nike by switching to custom made hockey shoes, as the Nike shoes cause his feet to swell, and also does not inform Nike. He then proceeds to play with his custom made shoes after this point.
Another issue that the club has to compete with is the individual contracts between the club and each of its members, who are now supposed to terminate their agreement and are seeking damages as they wish to change clubs.
Raj then discovers later that his agent had a long term association with Queensland, and went behind his back and received extra grants ($10,000) for obtaining Raj’s services. Raj’s Agent also disclosed a number of chapters of a copy of a hockey manual that Raj was writing in his free time to an online publishing house and that the agent received a further $25,000.
Legality of the contract
Contract formation requires several key elements, and offer, an acceptance of that offer and the element of consideration. Consideration is the value paid for the promise to perform in order to make it binding#. In this case The offer was made by the club for Raj to play mixed hockey, Raj accepted that offer, but nothing in the facts alleges there was something given in
