Kudler Fine Foods is currently transitioning itself towards adding a catering service and including organic products from local growers. As a result, Kathy Kudler has decided to shut down some departments for three months of refurbishing. This will result in the termination of some employees. When Kudler Fine Foods shuts down its deli, confectionary on-site meal preparation departments during it’s time of refurbishment, many legalities must be considered by both employee and employer.
Legally, Kathy Kudler has the right to shut down any department in her stores for any reason. Kudler Fine Foods enforces an employment at will policy. According to the employee handbook, “KFF has the right to add new policies, change policies, or cancel policies at any time. The only policy we will never change or cancel is our employment-at-will policy. The employment-at-will policy allows you or KFF to terminate your employment at any time for any reason” (University of Phoenix, 2008). The company is obligated to make sure that terminated employees are protected and fairly compensated for their services through its unemployment services. Kathy must also take into consideration a possible decline in employee morale is employees feel that their job security is at risk. If employee morale declines it could potentially affect Kathy’s high standard of customer service. Before terminating employees, Kathy should consider cross training employees to fill the need positions within the catering and organic departments.
In an attempt to implement organic products into its inventory, Kudler Fine Foods has contacted local growers. The local growers have requested for contracts with Kudler Fine Foods so they can have some certainty regarding where their produce is sold. By entering into a contract with the growers, each party is accepting a legally binding, and voluntary agreement.
