Legal Issues in Reduction of Workforce Simulation
A $25 million dollar company, FastServe Inc., employs 350 people who are directly involved with the sports apparel marketing. “Increased competition and rapidly developing technologies are leading companies to make innovations in how they operate, organize work and manage people. As employers increasingly take advantage of new technology they are finding the need to restructure staff and supervisors” (Lieberman, Moss, 2001). The changes needed present legal challenges and various risks for human resources; however, with adequate planning the possibility for encountering charges of discrimination or other employment law issues predicted and circumvented. This paper will identify the five candidates for dismissal along with the concepts of employment law that would have an effect on employment status, the interests of the organization and the balance of risk along with a proposed solution to the company’s current situation.
Situation Analysis
FastServe Inc. is a sound company immersed in the direct marketing of branded sports apparel. FastServe Inc. has made the decision to withdraw from online distribution due to the decrease in sales transactions in the online division and downsize the department. “The only concession made was that a few people among the identified employees might be retained with new job definitions based on past performances and skill levels” (Simulation, 2008). The primary reason for Fast Serve’s recent reduction of its workforce is due to cutting costs.
